National School of Clerks > Presentation

           National School of Clerks is a public institution with legal personality, being coordinated by the Superior Council of Magistracy. NSC is responsible with the initial and continuous training of clerks and other speciality auxiliary personnel of courts and prosecutors' offices, in accordance to law.
            This institution was established by Government Decision no. 423/1999 regarding the Establishment of the Training and Perfectioning Center for Clerks and Other Specialty Personnel, amended by GD no. 985/2000.
The activity of the National School of Clerks is regulated by the provisions of Chapter III of law no. 567/2004 regarding the Statute of specialty auxiliary personnel of courts and prosecutors' offices attached to them, as well as by regulations emitted in accordance to this law.
National School of Clerks is financed by the State budget, through the budget of Superior Council of Magistracy.
National School of Clerks is not part of the national educational system and it is not subject to the legal provisions regarding the authority of education institutions.

National School of Clerks is led by a leading board formed of 9 members:
• a judge and a prosecutor appointed by Superior Council of Magistracy;
• 2 representatives elected within the teaching personnel of NSC;
• a representative of the Directorate for Human Resources and Organization within Superior Council of Magistracy;
• 2 representatives of the students, one with university education and one with high school education;
• The director of National School of Clerks, which is a member de jure of the leading board and is the president of its sessions.

Nominal structure of the leading board:

• Judge Gheorghe BUTA – High Court of Cassation and Justice;
• First prosecutor Liviu BECERU – Prosecutors' office attached to Paşcani First instance court;
• Judge Tania BĂDIN – teaching personnel of National School of Clerks;  
• Judge Lucia ROG - teaching personnel of National School of Clerks;
• Judge Corina CORBU – Director of Directorate for Human Resources and Organization within Superior Council of Magistracy;
• Mihai Tiberiu SELEGEAN – Director of National Institute of Magistracy;
• Judge Cristiana-Mihaela CRĂCIUNESCU – Director of National School of Clerks;
• Two representatives of the students: Melania MARCU and Marius MIHALAŞCU.
        
The current leadership of National School of Clerks is assured by the director, two deputy directors and an economic director.
 
Nominal structure of the leadership of National School of Clerks:

• Judge Cristiana-Mihaela CRĂCIUNESCU – Director of National School of Clerks
• Judge Pavel COZMฮNCĂ – Deputy Director of National School of Clerks;  
• Cornelia NIŢU – Economic Director of National School of Clerks.  

The attributions of Superior Council of Magistracy with regard to the National School of Clerks are regulated by the Regulation for organization and functioning of Superior Council of Magistracy, approved by SCM Decision no. 326/2005 published in Romanian Official Journal, Part I, no.867 of 27/09/2005.
According to the provisions of the Regulation for organization and functioning of SCM, the Council has the following attributions:

The Plenum has the following attributions:
ุ                 at the proposal of the leading board of National School of Clerks, establishes the annual number of students, approves the date and place for the organization of the admission contest to National School of Clerks, establishes the thematic for this contest and approves the initial and continuous training curricula for clerks, issues endorsements and adopts regulations, in cases and conditions provided by law (art. 19 point 15 of the Regulation);
ุ                 appoints and revokes the director and the deputy directors of National School of Clerks, appoints judges and prosecutors as members in the Leading Board and appoints the teaching personnel; (art. 19 point 16 of the Regulation);

 Under the authority of the President and Vice-president of the Council, the general secretary coordinates and assures the proper functioning of the compartments within SCM technical-administrative body:

ุ         assures the cooperation with courts and prosecutors' offices, with National Institute of Magistracy, National School of Clerks, Ministry of Justice and other institutions and authorities, according to law (art. 48 para. 1 letter. a of the Regulation);

Service for human resources for courts has the following attributions:
ุ         elaborates the documents regarding the secondment of judges within Superior Council of Magistracy, National Institute of Magistracy, National School of Clerks, Ministry of Justice or any other units coordinated by them or public authorities, at the judges' request. (art. 59 letter. i of the Regulation);
 
Service for human resources for prosecutors' offices has the following attributions:
ุ         elaborates the documents regarding the secondment of prosecutors within Superior Council of Magistracy, National Institute of Magistracy, National School of Clerks, Ministry of Justice or any other units coordinated by them or public authorities, at the prosecutors' request. (art. 60 letter. j of the Regulation);

Service for organization of courts and prosecutors' offices has the following attributions:
ุ         keeps evidence of all the positions within courts and prosecutors' offices, proposes the number of places for the admission contest to National School of Clerks and elaborates, together with a representative of NSC, the repartition in vacant positions of the NSC's graduates. (art. 63 para. 1 letter k of the Regulation);

Service for recruitment, training and professional perfection has the following attributions:
ุ         elaborates the necessary documents for the organizational attributions of SCM with regard to the annual number of students of National Institute of Magistracy and the organization of admission contests at National Institute of Magistracy and National School of Clerks (art. 64 para. 1 letter a of the Regulation);
ุ         coordinates the activity for training and professional perfection of judges, prosecutors and auxiliary personnel from courts and prosecutors' offices, as well as other personnel within the judiciary, organized by National Institute of Magistracy and National School of Clerks (art. 64 para. 1 letter e of the Regulation);
